www.stellaforest.fr (the Website) is published by the company FIDLER, LLC with a capital of 8,000 euros, registered in the PARIS Trade and Companies Register under the number 419 493 352, whose headquarters are located at 17, Rue de Palestro, 75002 PARIS, represented by Mrs Christel BONIFACE, manager.
 

The general conditions of sale (GCS) detailed below apply to all orders of products placed via the Site by a natural person having the capacity to contract who has the quality of consumer, i.e. who does not intervene within the framework of his professional activity (the "Client").
Fidler acknowledges that these GCS prevail over all other documents. Any order requires the unconditional acceptance of the GCS which consists in the fact that the Client ticks the box corresponding to the sentence "I have read and I accept the general sales conditions".
Fidler reserves the right to adapt or modify at any time the present GCS. The version of the GTC applicable to any sale will be the one in force on the day of the order.
 
 

Only Clients residing in countries where delivery is available may place an order on the Site, i.e. Clients residing in metropolitan France, the United Kingdom, Belgium, the Netherlands, Luxembourg, Austria, Italy, Portugal and Germany.
The Client will have to create a Client account and fill in an order form with certain mandatory fields so that the order can be taken into account by Fidler.
The creation of an account requires the choice of login details by the Client (e-mail address and password). The Client acknowledges that his identifiers and passwords are strictly personal and confidential. Consequently, the Client shall not communicate or share them with third parties.
The Client agrees to provide complete, accurate and up-to-date information. Fidler may, if necessary, ask the Client to confirm -by any means- this information and his identity.
The creation of an account and the execution of the order implies for the Client the supply of personal data, processed by Fidler. This data is collected in accordance with the existing regulations and under the conditions defined in the Privacy Policy accessible HERE.
 

For the purpose of ordering the Products, the Client must select the Products that they wish to order on the Site by clicking on "Add to basket" and validate the different stages of the order.
The Client will have the possibility, before definitively validating their order, to check the summary of the order and its total price, and to correct possible errors, before confirming it to express their acceptance.
Fidler commits itself to honour the orders received on the Site only within the limit of the available stocks of Products. If the Products are not available, Fidler commits to inform the Client as soon as possible, and at the latest within 4 working days following the validation of the order. The cancellation of the order of this Product and its possible reimbursement will then be carried out.
Fidler is entitled to refuse any order made by a Client with whom there is a dispute relating to the payment of a previous order, as well as any order that does not comply with the present general terms of sale.
In this case, Fidler will inform the Client by phone or by email. Fidler reserves the right not to process the order if no modification is made by the Client concerning the erroneous elements.
Once the Client has validated their order, Fidler acknowledges receipt by email sent to the address communicated by the Client.
This confirmation email includes all the information relating to the order and in particular :

• The price of the Products
• The quantity to be delivered
• The date of the order
• The delivery costs, if any
• The payment method chosen by the Client
• The mention that the Client benefits from a right of withdrawal

 
It is recommended that the Client keeps a copy of the elements relating to their order.
Any modification of the order is impossible from the moment it is confirmed by Fidler. The Client has one (1) hour to cancel their Order from the moment it has been validated by them.
 
The Client may contact the customer support by email at contact@stellaforest.fr to check the status of their order.
 

The prices displayed on the Site are indicated in euros.
Prices are inclusive of all taxes, excluding delivery charges, customs duties and other taxes. The prices invoiced are those in force on the date of the order.
All payments on the site can be made by credit card (CB, Visa, Mastercard, American Express) or by a Paypal account.
Concerning the payments by credit card, the Client must be the holder of the credit card used. The Client accesses a dedicated space provided by a banking institution, which ensures the security and registration of the payment order.
Payments by gift card: the Stella Forest gift card is valid in Stella Forest shops located in metropolitan France and on the Internet (excluding department stores' stands and outlets). It can be used to purchase any product on sale. It is credited with the amount of the buyer's choice, which can range from 20 to 500 euros.
The balance of the card can be consulted on the Website.
It is valid for one year from the date of activation.
It cannot be taken back, exchanged or refunded for any reason.
It may be used one or several times within the limit of the amount credited, in full or in part.
It is not nominative. Its use is the responsibility of the beneficiary carrying it.
 
 

Delivery can be made to the Client's home, to a Pick-up & Go store, or to a Shop, as chosen by the Client when placing the order.
Delivery means the transfer to the Client of physical possession of the products.
The delivery costs applicable to the order are mentioned on the Site when choosing the delivery method and in the order summary.
In the case of home delivery, the address mentioned must be the Client's home address, that of a natural person of his choice or that of a legal person (delivery to their company). The delivery cannot be made to hotels or to post office boxes.
The Client will be able to track their parcel thanks to the tracking number which will be communicated to them by email at the time of sending the order.
In the event that delivery cannot be carried out due to an incorrect address or if the Client fails to collect the Order within fifteen (15) days of receiving it, no reshipment shall be made. The Client will be reimbursed within five (5) days of Fidler receiving the Order.
Fidler delivers the Orders within a maximum period of twelve (12) working days for a delivery in Metropolitan France and twenty (20) working days for an international delivery, this period being counted from the first working day after the validation of the Order.
During periods when new products are available online, and during operations (sales, private sales) the delivery time may be increased by ten (10) days due to the large and exceptional volume of Orders.
In order for the deliveries to be carried out within the deadlines, the Client must make sure to have communicated exact and complete information concerning the delivery address.
Fidler will not be held responsible for any delay in delivery that is not due to Fidler or to a case of force majeure.
If the delivery time is exceeded, the Client will be able, after formal notice sent to Fidler to carry out the delivery, remained unsuccessful, to ask for the cancellation of the sale and to obtain within a maximum period of fourteen (14) days of his request in this sense the reimbursement of the sums paid.
Outside the European Union, it is reminded that the delivery can be delayed as long as the formalities and customs fees have not been paid by the Client, which they accept. Fidler has no control over these fees. Customs policies vary greatly from one country to another, the Client must contact the local customs service for more information. Furthermore, when the Client places an order on the Site, they are considered the importer of record and must comply with all laws and regulations in which they receive the products.

 

The Client has a right of withdrawal which they may exercise, without having to justify their reasons, within a legal period of fourteen (14) calendar days from the receipt of their order. If this period expires on a Saturday, Sunday or public holiday, it is extended until the next working day.
To do this, the Client may send a letter to 17, rue de Palestro, 75002 PARIS on plain paper or via the withdrawal form sent in the order summary or notify the return directly on the site under the heading "My Account" then "Make a return request". In this case, the Client may choose between a refund or a credit note.
 
The Client may also contact Client service by e-mail for any additional information.
 
The Products must be returned in their original condition and labelled to the following address Stella Forest, Service client Internet, 17 rue de Palestro 75002 PARIS. The Client may select the carrier of their choice by requesting a shipment with tracking option and reception against signature.
Products returned incomplete or in a state of depreciation resulting from handling other than that necessary to establish the nature and characteristics of the Product will not be refunded.

The return of the products is taken care of by Fidler if the place of delivery is located in France or in Belgium. It is at the expense of the Client if the place of delivery is not among the above mentioned countries.
Refunds will be made within 14 days after Fidler has received the products.
 

The Products sold on the Site are subject to the legal guarantee of conformity: “The seller is bound to deliver a good in conformity with the contract and is responsible for any defects in conformity existing at the time of delivery. The seller is also responsible for defects in conformity resulting from the packaging, the assembly instructions or the installation when the latter has been put at their charge by the contract or has been carried out under their responsibility”.
The action resulting from the lack of conformity shall be barred within two years from the delivery of the product.
Defects of conformity that appear within twenty-four months of delivery of the goods are presumed to have existed at the time of delivery unless proven otherwise.
The Products offered on the Site are also subject to the guarantee against hidden defects:
“The seller is bound by the warranty for hidden defects of the item sold which render it unfit for the purpose for which it was intended, or which so diminish this use so much that the buyer would not have acquired it, or would have given a lower price if he had known”.
The action resulting from hidden defects must be brought within two years of the discovery of the defect.
The Client may decide to implement the guarantee against hidden defects in the item sold by choosing between the cancellation of the sale or a reduction in the sale price.
 
 

Fidler is the sole owner of the intellectual property rights on the Products offered on the Site, on the brands, designs and models and copyrights associated with the Products, on the Site and all its elements, in particular on the visual and graphic identity, on its design, on its ergonomics, on its functionalities, on the software, the logo, the texts, the photos, the videos and the domain name.
It is prohibited to use the brands, images, drawings and models or any other element on which Fidler would hold intellectual property rights.

It is also prohibited to copy, modify, create a derivative work, reverse engineer or assemble or in any other way attempt to find the source code, sell, assign, sub-license or transfer in any way whatsoever any right relating to the software.
 
It is also prohibited to modify the software or to use modified versions of the software and in particular (without this enumeration being restrictive) in order to obtain unauthorised access to the service and to access the Site by other means than by the interface which is provided by Fidler for this purpose.
 

The equipment (computer, software, means of telecommunication, etc.) allowing access to the Site is the exclusive responsibility of the Client, as are the telecommunication costs incurred by their use.
The Client acknowledges and accepts that no one shall guarantee the proper functioning of the Internet as a whole. In case of impossibility of access to the Site, due to technical problems or of any other nature, the Client will not be able to claim any damage or compensation.
Fidler has taken all the necessary precautions to ensure that all the Products have been described correctly. Nevertheless, it is specified that :

• the weights, measures, sizes and capacities indicated on the Site are only approximate;
• although Fidler tries to present on the Site the real colours of its Products, the colours that the Client sees will depend on the computer screen used and the display configurations and Fidler cannot therefore guarantee that the colour display by the screen corresponds exactly to the colour of the Products that the Client will receive.

In any case, Fidler's responsibility could not be engaged in the case where the non-execution of its obligations would be attributable either to the unforeseeable and insurmountable fact of a third party to the Contract or to a case of force majeure as defined by the French jurisprudence, or to the fact of the Client

In the event that one of the clauses of the GCS is declared null and void, this shall in no way affect the other provisions of the GCS.
 

The computerised registers are considered as proof of the communications, orders and payments made between the Parties.
 

The archiving of order forms and invoices is carried out on a reliable and sustainable medium so as to correspond to a faithful and sustainable copy.
 
 

The present GCS are subject to French law.
 
Any legal action relating to the conclusion, interpretation, performance or termination of this contract shall be subject to the jurisdiction of the Court of the place of residence of the defendant or, at the choice of the plaintiff, of the place of actual delivery of the Product in accordance with Articles 42 and 46 of the Code of Civil Procedure.
 
The English version of the general conditions of sale is only a translation, only the original French text is authentic.
 

ARTICLE 1 - GAME WITH PURCHASE OBLIGATION
The company FIDLER, ARL with a capital of 8 000 euros, registered at the Registre du Commerce et des Sociétés de PARIS under the number 419 493 352, whose registered office is located at 17, Rue de Palestro, 75002 PARIS, represented by Mrs Christel BONIFACE, in her capacity as Managing Director, referred to as the "Organiser", is organising the "Ticket d'Or" game, which will run from 13 December 2023, the first day on which prizes (pallets of PAPs) containing a Ticket d'Or can be sold, until 31 December 2023, the deadline for declaring oneself a winner in the game (hereinafter referred to as the "Game").


The Game is a game with a purchase obligation deployed in metropolitan France and Europe and is reserved for natural persons of legal age.
Participation in the Game implies express and unreserved acceptance of these rules (the "Rules"), in all their stipulations, as well as the laws and regulations in force on French territory and in particular the provisions applicable to lotteries in force in France.
 
ARTICLE 2 - PRIZES TO BE WON
Each "Golden Ticket" found entitles the holder to win 1 voucher worth €200 (two hundred euros) inclusive of all taxes (hereinafter "inclusive of all taxes") to be used on the website until 30 June 2023.
4 winning tickets will be added for every 200 orders placed on our online eshop www.stellaforest.fr. 
Each participant may only win one ticket (same name, same postal address and/or same e-mail address) over the entire period of the Contest.
 
ARTICLE 3 - DESCRIPTION OF THE GAME, DURATION AND TERMS OF PARTICIPATION
3.1 Description of the Game
The Game consists of finding one of the four "Golden Tickets" that have been slipped into web orders. In order to do so, a purchase must be made on the website www.stellaforest.fr in Article 2 of these rules.
Each "Golden Ticket" contains a promotional code that can be used on the website.
If a Golden Ticket is found, the participant who has found the ticket in his/her order must use the promo code entered before 30 June 2023 online. 
Any participant who does not use his/her promotional code before the expiry date of 30/06/2023 in accordance with the terms and conditions set out in these Rules will not be entitled to his/her prize.
 
3.2 Duration
The Game runs from Wednesday 13 December 2023 until 30 June 2023 in accordance with the terms and conditions set out in these Rules.
The Organiser reserves the right to shorten, extend, postpone, modify or cancel the Contest if circumstances so require. In any event, the Organiser may not be held liable and no compensation may be claimed in this respect. The Organiser will put in place the technical means to inform participants of these cases.
 
3.3 Terms and conditions of participation
This game with an obligation to purchase is deployed in metropolitan France and Europe and is reserved for natural persons of legal age.
All participation must be fair. Consequently, it is strictly forbidden, by any means whatsoever, to modify or attempt to modify the game systems offered, in particular in order to modify the results. 
The prize awarded to the winners may not be contested in any way, nor may it be exchanged or replaced, for any reason whatsoever. The prize must be taken as is.
The prize is nominative and may not be awarded to anyone other than the person designated in the context of this Contest. Consequently, no claim of any kind will be entertained. If circumstances so require, the Organiser reserves the right to replace the prize won with a prize of equivalent value and, as far as possible, with similar characteristics.
Any participation that does not comply with the present Rules (i.e. inaccurate or in the case of multiple entries) will result in the cancellation of the participation.
 
ARTICLE 4 - OBLIGATION TO PURCHASE
Participation in the Contest is free of charge, but an online purchase must be made in order to try to win a golden ticket.
 
ARTICLE 5 - RIGHT TO VERIFY THE IDENTITY OF THE WINNERS
The winners authorise any verification regarding their identity, domicile and email address, or their non-membership of FIDLER. Any false or erroneous indication of identity or postal or e-mail address or any affiliation with FIDLER will automatically result in elimination from the competition. 
 
ARTICLE 6 - LIABILITY
FIDLER shall not be liable for any incidents or accidents which may occur during the enjoyment of the prize or which may affect the prize. FIDLER's liability is strictly limited to the delivery of the prize actually and validly won. In no event will FIDLER be liable for any direct or indirect consequential or incidental damages whatsoever arising out of or in connection with the use of the prize.
